Terms of Service

1. Acceptance of Terms

Welcome to Catchsera. By accessing www.catchsera.com or www.care.catchsera.com, or by using our services, you agree to be legally bound by these Terms of Service provided by Smart Zone Corp dba Catchsera. If you do not agree to these terms, do not use our services.

2. Services

Catchsera provides AI-powered voice reception and lead capture services for dental and medical offices. Our service answers inbound calls, collects caller information, and notifies your team — operating as a virtual receptionist on your behalf.

3. Free Trial

• We offer a 7-day free trial for all new accounts
• A valid payment method is required to start the free trial
• No charges are applied during the 7-day trial period
• The free trial provides full access to all features of your selected plan
• At the end of the 7-day trial, your subscription will begin automatically unless cancelled
• We will notify you by email before your trial ends
• You may cancel at any time during the trial with no charge

4. Fees and Billing

Pricing is based on a recurring monthly subscription:

• Starter Plan: $129.00 per month — 200 minutes, 1 simultaneous call
• Growth Plan: $329.00 per month — 600 minutes, 3 simultaneous calls
• Professional Plan: $497.00 per month — 2,000 minutes, unlimited simultaneous calls
• Enterprise Plan: Custom pricing as agreed in writing

All payments are processed securely via Stripe. Billing cycles begin on the date you subscribe after your free trial ends. All fees are in US dollars (USD). We reserve the right to change pricing with 30 days written notice.

5. Cancellation Policy

• You may cancel at any time by emailing contact@catchsera.com
• Cancellations must be submitted at least 5 business days before your next billing date
• Your service remains active until the end of your current paid billing period
• No further charges will be applied after cancellation
• Your AI agent will be deactivated at the end of the paid period
• We do not prorate partial months

6. Refund Policy

After the trial, all fees are non-refundable once the AI Agent has been configured, approved, and deployed. Refunds may be considered if:

• A technical failure on our side prevented service for more than 72 consecutive hours
• You were charged in error or a duplicate charge occurred
• Within the first 30 days — contact us and we will review case-by-case

To request a refund consideration, email contact@catchsera.com with your account details and reason.

7. Service Setup and Delivery

• Your custom AI agent will be built and delivered within 1-2 business days after subscribing
• You will receive a dedicated demo phone number to call and hear your agent before it goes live
• You must approve the agent before it handles live patient calls
• Setup requires you to forward your phone number to our system — we provide complete instructions and can assist in person
• We do not modify, access, or touch your existing phone system infrastructure in any way

8. SMS Messaging and Opt-Out

• By providing your phone number and checking the SMS consent box, you opt-in to receive SMS notifications related to your service
• Opt-Out: Text "STOP" at any time to unsubscribe
• Help: Text "HELP" or email contact@catchsera.com
• Mobile information will not be shared with third parties for marketing purposes

9. Call Recording Disclosure

We monitor and record calls for quality assurance and AI training. Our AI agent discloses at the start of every call that it is an AI virtual assistant and that the call may be recorded — required by Massachusetts two-party consent law (M.G.L. c. 272 § 99). You must not remove or disable this disclosure.

10. HIPAA Compliance

• Catchsera functions as a Business Associate under HIPAA (45 CFR Parts 160 and 164)
• We execute a BAA with all covered entities before service activation
• Do not activate our service for healthcare patients until a BAA is signed
• Our AI agents are strictly prohibited from requesting PHI, providing medical advice, or recommending treatments or medications
• All subprocessors who may handle PHI are bound by BAAs in compliance with HIPAA 45 CFR Parts 160 and 164

11. Service Termination by Catchsera

We reserve the right to suspend or terminate your account immediately if you:

• Violate these Terms of Service
• Use the service for illegal purposes
• Fail to pay after 10 days past due date
• Remove required AI disclosure or call recording disclosures from the agent
• Attempt to use the AI for medical advice or clinical guidance

12. Limitation of Liability

To the maximum extent permitted by law, the total liability of Smart Zone Corp for any claim shall not exceed the total amount of fees actually paid by you during the twelve (12) months preceding the claim.

We provide an AI-driven service "as-is" and are not liable for technical inaccuracies, missed appointments, lost revenue, interruptions in telephone carrier service, or any indirect or consequential damages.

13. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, United States. Any disputes shall be resolved in the courts of Norfolk County, Massachusetts. Both parties agree to attempt good-faith resolution before initiating legal proceedings.

14. Changes to These Terms

We may update these Terms at any time. We will notify you by email at least 14 days before material changes take effect. Continued use of our service after changes constitutes acceptance of the updated terms.
